Terms of Service
Welcome to Techwillow Studio. Please read these Terms of Service (“Terms”) carefully before using the Techwillow Studio website and platform (the “Service”) operated by Techwillow Inc. (“we,” “us,” or “our”), a company incorporated in Ontario, Canada.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding contract.
1. Agreement to Terms
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you disagree with any part of the Terms, you may not access the Service.
2. Description of Service
Techwillow Studio provides an AI-powered educational platform designed to assist parents and educators in generating Ontario curriculum-aligned worksheets for students in Grades 1–12. The Service includes:
- Worksheet Generation: AI-based tools to create custom practice worksheets aligned with the Ontario Curriculum for Mathematics and Science.
- Parent Dashboard: A management interface for tracking child progress, viewing worksheet history, and managing child profiles.
- Child Mode: A PIN-protected focused learning mode for children to complete assigned worksheets and practice exercises.
- PDF Downloads: The ability to download and print worksheets as PDF documents.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable prior notice where practicable.
3. Accounts and Security
3.1 Account Creation
When you create an account, you agree to:
- Provide accurate, complete, and current information at registration.
- Maintain and promptly update your account information to keep it accurate and current.
- Not create an account on behalf of another adult without their explicit permission.
- Be solely responsible for all activity that occurs under your account.
3.2 Account Security
You are responsible for safeguarding your password and for any activity that occurs under your credentials. You agree not to disclose your password to any third party. You must notify us immediately at privacy@techwillow.ca upon becoming aware of any breach of security or unauthorised use of your account.
3.3 Parental Responsibility for Child Profiles
If you create child profiles within your account, you represent that you are the parent or legal guardian of those children and you consent to our limited collection and use of their information as described in our Privacy Policy.
4. Subscriptions, Payments, and Billing
4.1 Subscription Plans and Automatic Renewal
The Service is available on a free tier (Explorer) and paid subscription plans (Starter and Professional). Paid plans are billed on a recurring monthly or annual basis, depending on the plan you select. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. Current plan details and pricing are available on our pricing page.
4.2 Payment Processing
Payments are processed by Stripe, our third-party payment processor. By providing your payment information, you authorise Stripe to charge your payment method for the applicable recurring fees. We do not store your complete payment card details on our servers. Stripe’s terms of service and privacy policy govern the processing of your payment information.
4.3 Cancellation
You may cancel your subscription at any time through your account settings or via the billing portal. Cancellation takes effect at the end of your current billing period; you will retain access to paid features until that date. After that date, your account reverts to the free Explorer tier.
4.4 Content Retention and Storage
The following storage retention policies apply to worksheets and generated PDFs based on your subscription plan:
- Explorer (Free): Your 3 lifetime worksheet generations and their PDF files are stored permanently at no charge.
- Starter: Worksheets and PDFs are retained for 90 days from the date of generation. Files older than 90 days are automatically and permanently deleted.
- Professional & Premium: Worksheets and PDFs are stored permanently for as long as your subscription remains active. Upon cancellation or downgrade, a 90-day grace period begins, after which files will be permanently deleted.
We recommend downloading any important worksheets before your retention period or grace period expires. Techwillow Inc. is not liable for data loss resulting from subscription cancellation, expiry, or plan downgrade.
4.5 Refunds
Refunds for subscription fees are generally not provided for partial subscription periods. Exceptions may be considered on a case-by-case basis at our sole discretion. If you believe you are entitled to a refund, please contact us at support@techwillow.ca within 7 days of the relevant charge.
4.6 Price Changes
We reserve the right to modify subscription pricing with at least 30 days’ written notice to active subscribers. Your continued use of the paid Service after the price change takes effect constitutes your agreement to pay the modified amount.
5. AI-Generated Content Disclaimer
The worksheets generated by Techwillow Studio are created using artificial intelligence. While we strive for accuracy and curriculum alignment:
- AI-generated content may contain errors, inaccuracies, or content that is not suitable for every specific educational context.
- All generated worksheets should be reviewed by a parent or educator before use with a child.
- We are not responsible for any educational outcomes, or for any errors or omissions in AI-generated content.
- Curriculum alignment is based on the Ontario Curriculum documents available at the time of development. Provincial curriculum updates may not immediately be reflected in our system.
6. Intellectual Property
6.1 Our Content
The Service, including its software, design, features, and original content (excluding user-generated content), is the exclusive property of Techwillow Inc. and is protected by Canadian copyright, trademark, and other applicable laws.
6.2 Your Generated Content
You own the worksheets and content you generate using the Service. You grant us a limited, non-exclusive licence to store and deliver your generated content to you via the Service. Your use of generated worksheets is limited to personal, non-commercial educational purposes. Commercial redistribution, resale, or use of generated content as part of a paid service requires our prior written approval. You represent that your use of the Service does not infringe any third-party rights.
6.3 Feedback
If you submit feedback, ideas, or suggestions about the Service, you grant us an irrevocable, royalty-free licence to use such feedback without restriction or compensation to you.
7. Acceptable Use
You agree not to use the Service:
- In any way that violates applicable Canadian federal, provincial, or international law.
- To exploit, harm, or attempt to harm minors in any way.
- To attempt to reverse-engineer, decompile, or extract the source code of any part of the Service.
- To use automated scripts, bots, or scraping tools to access or extract data from the Service.
- To impersonate Techwillow, a Techwillow employee, another user, or any other person or entity.
- To introduce malicious code, viruses, or any other technology that may harm the Service or its users.
- To use the Service to generate content for any purpose other than personal, non-commercial educational use without prior written approval.
8. Termination
We may suspend or terminate your account immediately, without prior notice or liability, if you breach these Terms or if we determine that your use of the Service poses a risk to other users or to the platform. Upon termination, your right to use the Service will cease immediately.
You may terminate your account at any time through your account settings. Following termination, your personal information will be handled in accordance with our Privacy Policy.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected. AI-generated content is provided without warranty of accuracy, completeness, or curriculum suitability.
10. Limitation of Liability
To the maximum extent permitted by applicable Canadian law, Techwillow Inc., its directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from:
- Your access to or use of (or inability to access or use) the Service;
- Any conduct or content of third parties on the Service;
- Any AI-generated content obtained from the Service;
- Unauthorised access, use, or alteration of your transmissions or data.
In no event shall our total liability to you for all claims exceed the greater of (a) the amount you paid to us in the 12 months preceding the event giving rise to the claim, or (b) CAD $100.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if unsuccessful, through the courts of Ontario, Canada. You consent to the exclusive jurisdiction of such courts.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email and/or by a prominent notice on our website at least 14 days before they take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
13. General
13.1 Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
13.2 Force Majeure
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemic, war, cyberattacks, or failures of third-party infrastructure providers.
13.3 Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Techwillow Inc. regarding the Service and supersede all prior and contemporaneous agreements, representations, and understandings.
